According to the latest law L4042 / 7-2-2012 “Criminal protection of the environment – Harmonization with Directive 2008/99 / EC – Waste generation and management framework – Harmonization with Directive 2008/98 / EC – Regulation of issues of the Ministry of Environment, Energy and Climate Change “, the cases that require the compilation of a dependent topographic diagram in the Hellenic Geodetic Reference System 87 ‘(EGSA 87’) are identified.
- Topographic that has been prepared for the Purchase and Sale of Land or Agricultural Parcels, Real Estate Transfers, Parental Benefits but also for
- Certificate of Arbitrary Regulation which is issued in accordance with the new Law 4014/2011 on the Regulation of Arbitrary Structures in which it is declared and certified that no arbitrary constructions have been performed on the property and no arbitrary uses have been installed (art. 23§4)
The topographic diagram is REQUIRED to be dependent on EGSA 87 ‘when:
- THE PROPERTY IS LOCATED OUT OF THE CITY PLAN AND IS A STRUCTURED PLOT
- THE PROPERTY IS LOCATED OUT OF THE CITY PLAN, IS AN UNBUILT PLOT AND IS LOCATED OVER THE DISTRIBUTION OF THE INTEGRATED MANAGEMENT & CONTROL SYSTEM
NO DEPENDENT TOPOGRAPHIC DIAGRAM IS REQUIRED in cases where:
- THE PROPERTY IS LOCATED WITHIN A CITY PLAN OR
- WITHIN THE SETTLEMENT OF A SETTLEMENT OF THE YEAR 2003 or
- WITHIN THE LIMITS OF SETTLEMENTS LESS THAN 2000 RESIDENTS
- THE PROPERTY IS LOCATED OUTSIDE THE CITY PLAN, IS A STRUCTURE PLOT AND IS LOCATED WITH THE DISTRIBUTION OF THE INTEGRATED SYSTEM OF MANAGEMENT & CONTROL
The topographic diagrams that need to be mentioned in the Hellenic Geodetic Reference System 87 ‘(EGSA 87’) are the topographic diagrams that have been compiled for the following reasons:
- Characterization Act by the competent Forest Service
- Plot Assessment Act
- Issuance of building permits according to the new specifications
- Σύνταξη Τεχνικών Εκθέσεων(Τ.Ε.) ή Διαγραμμάτων Εφαρμογής (Δ.Ε.)
- Διορθωτική Πράξη Εφαρμογής
- Diagram of Geometric Changes of the National Land Registry should be drawn up
- Private town planning or the Exchange of Forest Area
- Division – Separation of large Properties according to the provisions in force for each area
- Determination of Beach lines with a diagram integrated in the National network of coordinates EGSA ΄87 and according to the specifications defined by the existing legislation (2971 / 19-12-2001)
- Defining a stream boundary
- Environmental Licensing for Installation Studies for Photovoltaic Systems or Other Renewable Alternative Energy Sources
- To issue a water use permit for existing water rights and uses
